Welcome to Secure Private Sale Solutions LLC (“SPS”, “we”, “us”, or “our”). These Terms and Conditions (“Terms”) govern your use of our website, quoting tools, and the purchase of vehicle protection products offered through this site. By accessing or using our site or purchasing any product, you agree to be bound by these Terms.

1. Our Role
SPS is a licensed seller of vehicle service contracts and protection packages. While we may participate in certain backend support or performance programs for select products, we are not the administrator, obligor, or claims processor for any vehicle service contract sold through this site. All contractual obligations, claims handling, and service coverage are managed by the third-party administrators — such as Endurance and Smart AutoCare — named in your signed agreement.

2. Product Availability
Our products are not available to residents of the state of Washington. We reserve the right to restrict availability in other states as needed for legal or administrative reasons.

3. Quoting and Purchase Process
To generate a quote and purchase a protection product, you will need to provide your name, phone number, email address, physical address, and vehicle information. We use a secure quoting engine and checkout process. You do not need to create an account. Payment can be made by credit card or through PayPal, including PayPal Pay Later options.

All protection products require a digital signature at the time of purchase. Upon completion, you will receive a copy of the signed agreement via email.

Your email address may also be used to send promotional offers and cross-promotional materials from Secure Private Sale Solutions LLC and its affiliated brands, including GetAutoCoverageNow and MobileMechanicNow. You may unsubscribe at any time.

4. Refund and Cancellation Policy
Unless otherwise stated in the service contract, all protection plans purchased through SPS include a 30-day full refund period, provided no claims have been filed. See contract for complete details and limitations.

Please note:

Smart AutoCare’s Choice and Premium plans include a 30-day waiting period before coverage becomes active.

Claims submitted within the waiting period or related to pre-existing conditions are not covered.

5. No Warranty of Coverage Outside the Contract
Your purchase entitles you to the specific coverage, limits, exclusions, and conditions described in the actual service contract you sign. SPS makes no guarantees beyond what is stated in your signed agreement.

6. Intellectual Property
All content on this website — including text, logos, brochures, and graphics — is the property of SPS or our partners and may not be copied, modified, or reused without our written consent.

7. Limitation of Liability
SPS shall not be liable for any indirect, incidental, special, or consequential damages arising from or related to your use of the website or any service contract purchased through our platform.

8. Governing Law
These Terms are governed by the laws of the State of California, without regard to its conflict of law principles. All legal proceedings must be brought in Santa Clara County, California.

9. Dispute Resolution and Arbitration
You agree that any dispute, claim, or controversy between you and SPS arising out of or relating to these Terms or your use of the site or purchase of any product shall be resolved by binding arbitration, administered in accordance with the rules of the American Arbitration Association.

The arbitration will take place in Santa Clara County, California, and judgment on the award may be entered in any court having jurisdiction. You waive the right to a jury trial and to participate in any class action.

10. Modifications to Terms
We reserve the right to update these Terms at any time. Any changes will be posted to this page with a new effective date.

11. Additional Terms for Communications and Disclaimers
By submitting your information or purchasing through this website, you consent to receive communications from SPS regarding your quote, purchase, and product updates. This may include emails, text messages, and phone calls using automated technology or pre-recorded voice. Message and data rates may apply. You may opt out at any time by following the unsubscribe link or texting STOP to any SMS communication.

By submitting your email address to unlock discounts, promotions, or special offers, you further agree to receive marketing communications and cross-promotional offers from SPS and its affiliated brands, including GetAutoCoverageNow and MobileMechanicNow. These promotional communications are separate from transactional messages related to your purchase. You may unsubscribe from promotional emails at any time by clicking the unsubscribe link included in each email.

SPS does not provide legal or tax advice. You are encouraged to consult your own attorney or tax advisor regarding any questions about coverage suitability, contract terms, or related financial decisions.

Free Benefits Disclaimer: Complimentary benefits, including paintless dent repair, key fob repair/replacement, and windshield repair, are provided as add-ons and are subject to eligibility requirements and limitations. Eligibility: Current model year plus 21 prior model years, with less than 200,000 miles at the time of purchase. These benefits do not replace or extend the terms of any vehicle service contract or protection plan, and additional terms, conditions, and exclusions apply.
